TLDR:
1. General Terms – All Users
The Applied Behavior Academy LLC (“The ABAcademy”, “we”, “us”, “our”) operates an online platform (“Platform”) that connects Board Certified Behavior Analysts (BCBAs) who offer supervision (“Supervisors”) with individuals pursuing BCBA or BCaBA certification (“Supervisees”).
By creating an account or using the Platform, you (“User”, “you”, “your”) agree to these Terms and Conditions.
• The ABAcademy is not affiliated with, endorsed by, or sponsored by the Behavior Analyst Certification Board (BACB).
• The ABAcademy does not provide supervision services directly.
• The ABAcademy is not a party to the supervision contract between Supervisor and Supervisee.
• The ABAcademy provides the marketplace, payment processing, and tracking tools only.
Users must be at least 18 years of age and legally able to enter into a binding agreement.
All Supervisors are independent contractors. Supervisors are not employees of The ABAcademy, and The ABAcademy is not responsible for their professional conduct or supervision decisions.
2. Supervisee Terms (People Seeking Supervision)
As a Supervisee using the Platform, you agree to:
• Create an account with accurate, current information and keep it updated.
• Keep your login details private and notify us if you suspect unauthorized access.
• Submit a video introduction as part of your profile. This video may be viewed by Supervisors when you request supervision.
• Be honest in describing your experience, goals, and needs when requesting supervision.
You are solely responsible for:
• Making sure your hours and activities meet BACB experience standards.
• Keeping copies of your own supervision documents for the BACB-required retention period.
• Verifying that your Supervisor’s BACB certification is active and in good standing.
• Confirming that your Supervisor is legally allowed to supervise in your state or country.
The ABAcademy does not guarantee that:
• Your Supervisor’s hours will be accepted by the BACB.
• Your supervision arrangement will meet all state, national, or licensing requirements.
• You will pass BACB review or become certified.
You agree to log your fieldwork hours honestly and accurately, and to avoid including any protected health information or client identifying details in your hour descriptions.
If your BACB status changes (for example, if you are placed on probation or subject to disciplinary action), you agree to notify your Supervisor(s) and update your profile promptly.
3. Supervisor Terms (BCBAs Providing Supervision)
As a Supervisor using the Platform, you agree to:
• Submit a complete and truthful application, including your BACB certification number and supporting documents.
• Maintain active BACB certification and comply with BACB ethics requirements.
• Notify The ABAcademy if your certification status changes (for example, probation, suspension, or revocation).
• Verify that you are legally allowed to provide supervision in the Supervisee’s state or location, in line with licensing laws.
You are solely responsible for:
• The quality and content of the supervision you provide.
• Following BACB ethics standards and any applicable state, provincial, or national laws.
• Only supervising within your scope of competence.
You may set your own supervision rates and may update your rates for new supervision agreements. Rate changes for existing Supervisees require a new, signed contract between you and the Supervisee.
You agree to:
• Respond to supervision requests within a reasonable timeframe (for example, 24–48 hours where possible).
• Review and confirm or decline submitted hours within a reasonable timeframe (for example, within 5 business days).
• Only confirm hours for supervision that actually occurred.
Confirming hours that you did not provide is considered fraud and may result in removal from the Platform and possible reporting to relevant regulatory bodies.
4. Supervision Contracts and Relationships
The supervision agreement is between the Supervisor and Supervisee only.
• The ABAcademy is not a party to the supervision contract.
• The ABAcademy does not enforce contract terms or mediate disputes.
Before you begin logging or paying for supervision through the Platform:
• A signed supervision contract must exist between Supervisor and Supervisee.
• The contract should clearly describe supervision scope, frequency, rates, responsibilities, confidentiality, and termination procedures.
• A copy of the signed contract must be uploaded to the Platform for administrative approval.
If a supervision relationship ends, both parties are responsible for:
• Confirming or resolving any pending hours.
• Downloading any needed documents from the Platform before data is removed in line with the data retention policy.
5. Payments and Fees
The Platform uses third-party payment processors (for example, Stripe) to handle payments and payouts.
For Supervisees:
• You must keep a valid payment method on file.
• You authorize payment holds when you submit hours for confirmation.
• When the Supervisor confirms your hours, your payment method is charged.
• If payment fails, you agree to update your payment method promptly.
For Supervisors:
• You receive payouts for confirmed supervision sessions, minus the Platform’s transaction fee.
• The ABAcademy currently plans to charge a percentage fee on each transaction and may charge a small monthly platform fee when you have more than a set number of active supervisees. Details will be shown in your account.
• You are an independent contractor and are responsible for reporting your own income and handling your own taxes.
Platform fees help cover:
• Payment processing
• Platform maintenance, security, and support
• Tracking and document storage tools
The ABAcademy may update fees with advance notice. Continued use of the Platform after a fee change means you accept the new fee structure.
Refunds are limited to cases such as clear billing errors or technical issues. Disagreements about supervision quality or style are between Supervisor and Supervisee and are resolved outside The ABAcademy.
6. Data, Documents, and Storage
The ABAcademy is not a long-term document storage service. You are responsible for downloading and keeping your own copies of:
• Supervision contracts
• Fieldwork logs
• Monthly forms
• Meeting notes and related records
We may:
• Store documents while your account is active.
• Remove documents after a period of account inactivity, or after account closure, in line with our data retention policy.
You agree to download and back up your documents regularly to your own secure storage.
The ABAcademy is not liable for loss of documents due to inactivity, deletion, technical issues, or user error.
7. Compliance and Responsibility
The Platform is designed as a tool to support supervision; it is not a substitute for your own professional judgment or legal responsibilities.
• The ABAcademy is not responsible for ensuring BACB or state compliance.
• The ABAcademy does not guarantee that any supervision obtained through the Platform will be accepted by the BACB or any licensing board.
• You (both Supervisor and Supervisee) are responsible for understanding and following BACB requirements, state laws, and ethical codes.
If you become aware of serious ethical, legal, or professional concerns involving another user, you are encouraged to address them through appropriate channels (including the BACB, licensing boards, or legal counsel as needed).
8. Platform Use, Suspension, and Termination
You agree not to:
• Misrepresent your identity, credentials, or experience.
• Use the Platform for illegal purposes.
• Harass, threaten, or abuse other users.
• Bypass Platform payment processing or move supervision “off-platform” to avoid fees.
• Share your login with others.
The ABAcademy may suspend or terminate accounts if:
• There is suspected fraud or unethical behavior.
• Payment issues are not resolved.
• BACB certification or licensing becomes inactive (for Supervisors).
• Users violate these Terms or applicable laws.
If your account is closed, you should download all needed documents before closure. Data may be deleted after account closure according to the data retention policy.
9. Limitation of Liability
The Platform is provided “as is” and “as available.” While we aim to offer a useful service, we do not guarantee that the Platform will be error-free or uninterrupted.
To the maximum extent allowed by law:
• The ABAcademy is not liable for lost data, lost documents, supervision disputes, rejected certification applications, or any indirect or consequential damages.
• The total liability of The ABAcademy to any user is limited to the greater of one hundred dollars ($100) or the total fees you paid to The ABAcademy in the 12 months before the claim.
You agree that you use the Platform at your own risk and that supervision outcomes and certification decisions are outside The ABAcademy’s control.
